1. Use of Site

  • To the fullest extent permitted by law, Roots Realty Co., its owners, agents, affiliates, and contractors are not liable for any direct, indirect, incidental, consequential, punitive, or special damages of any kind, including lost profits or data, arising out of or related to your use of the Site.

  • Our total aggregate liability for any claim shall not exceed the greater of: (i) $100, or (ii) the amount you paid us in the 12 months prior to the claim.

You agree to indemnify, defend, and hold harmless Roots Realty Co. and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of your:

5. Dispute Resolution

  • Arbitration: Any dispute will be resolved exclusively by binding arbitration with the American Arbitration Association (AAA), under its Consumer Arbitration Rules.

  • Venue: Arbitration shall take place in Indianapolis, Indiana.

  • Waivers: You waive the right to jury trial and to participate in class actions or representative proceedings.

6. Intellectual Property

All content (text, graphics, design, guides, blogs, and branding) is owned by Roots Realty Co. You may not copy, reproduce, or distribute any materials without prior written consent.

7. Third-Party Services

  • Our Site may link to or integrate with third parties (lenders, inspectors, CRM platforms, Meta, Google, etc.).

  • We are not responsible for their actions, policies, or content. Use of third-party services is at your own risk.

8. Governing Law

These Terms are governed by the laws of the State of Indiana. If arbitration is found unenforceable, exclusive venue shall be the state or federal courts in Marion County, Indiana.

9. Modification of Terms

We may update these Terms at any time. Changes take effect when posted. Your continued use of the Site means you accept the updated Terms.
